Summary

Work out or liquidate classified assets through regular collection, sale of collateral, liquidation, and/or litigation.   Submit various documents and packages to SBA or State guarantee source. Train new Liquidation Analysts.

Responsibilities

  • Evaluate loans assigned by the Team Lead or the Vice President of Risk Management for payment ability and collection strategy.

  • Contact borrowers who are past due and collect past due funds.

  • Prepare demand letters to all required parties.

  • Prepare all required package documentation for Guaranty Purchase Packages and submit them to SBA.

  • Prepare and submit Debenture Purchase requests to SBA.

  • Prepare and submit Liquidation Plan packages to guaranteeing entities.

  • Prepare and submit Litigation Plan packages to SBA as necessary.

  • Prepare and submit Offers in Compromise packages to SBA as appropriate.

  • Prepare and submit required reports to guaranteeing entities.

  • Liquidate collateral as necessary, including foreclosure, repossession, supervise legal action.

  • Monitor bankruptcies and prepare and submit Proof of Claims.

  • Interface with real estate brokers, escrow/title companies, Borrowers, Guarantors, Third Party Lenders, appraisers, site visit personnel, environmental service company, Legal counsel for Borrowers/Guarantors, as well as our internal legal counsel, approved legal counsel, and SBA legal counsel.

  • Obtain Automatic Debit (ACH) information for loans which are not currently on ACH.

  • Update the SBA e-Trans system and advise CSA of ACH changes.

  • Update the SBA e-Trans system prior to submitting a Guaranty Purchase Package request to SBA.

  • Answer general servicing questions and ability to compile any necessary documents related to job functions.

  • Order site visits, appraisals, UCC searches, environmental reports, preliminary title reports.

  • Evaluate Notice of Default, Notice of Sale, and Trustee’s Sale Guarantee documents.

  • Prepare requests for payment of invoices for Vice President Risk Management review, and once approved, forward to Accounting for payment.

  • Follow for all required invoices and check copies with regard to payment of said invoices.

  • Prepare Wrap Up Reports as needed and submit to Vice President Risk Management or Team Lead for approval and submit to SBA.

  • Monitor for charge off status and expense reimbursement from guaranteeing entity.

  • Inform Vice President once charge off and expense reimbursement have been completed.  Recommend write down of any expenses not reimbursable by SBA.

  • Upload key documentation into the Ventures/BMI imaging system.

Requirements

  • Bachelor’s degree and/or equivalent experience.

  • A minimum of 5-7 years’ experience in collection, liquidation, litigation, and offers in compromise related to small business loans with 2-3 or more years’ experience with SBA 7(a) loan liquidation.

  • Proficiency with MS Office applications; Advanced Excel skills

  • Bankruptcy experience

  • Ability to prioritize, multi-task, and remain organized.

  • Strong written and verbal communication skills.

  • Have a working understanding of unauthorized transfer of title and due on sale clauses.

  • Have a working understanding of eviction proceedings, as well as receivership.

  • Have a working understanding of title policies, preliminary title reports, and UCC search reports.

  • Ability to learn and work in multiple programs/systems, such as Ventures+, the Central Servicing Agent (CSA) system, and the SBA e-Trans system.

  • A basic understanding of servicing type actions, such as deferment, changes in borrowing entities, releases, substitutions of parties and collateral, and assumption.

  • Flexibility to work on any high priority projects that may be assigned, including those that do not relate specifically to Risk Management and/or Liquidation.

  • Ability to quickly adapt to changes in policy or procedure.

  • Ability to understand loan documents and their function.

  • Ability to read and resolve any accounting related discrepancies.
